Terms of Service

Modern Leads is a B2B contact enrichment platform that helps sales and marketing professionals find verified business email addresses and phone numbers for their prospects. The service uses a “waterfall enrichment” approach — querying multiple data providers in sequence to maximize contact find rates.

The platform is accessible at app.modernleads.io and is intended for use by B2B teams in sales, business development, and marketing.

• Invite-only access: Modern Leads is currently invite-only. You may only create an account if you have received an invitation from us.
• One account per person: Each individual may only maintain one account. Creating multiple accounts to circumvent usage limits or restrictions is prohibited.
• Account security: You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• Accurate information: You must provide accurate and truthful information when registering and must keep your account information up to date.
• Age requirement: You must be at least 18 years old and have the legal authority to enter into these Terms, either on your own behalf or on behalf of your organization.

• Subscription: Access to Modern Leads requires an active monthly subscription. The subscription fee is charged at the start of each billing cycle.
• Credits: The enrichment service operates on a credit system. 1 credit is consumed per email lookup; 5 credits are consumed per phone number lookup. Your subscription includes a monthly credit allocation.
• Credit top-ups: Additional credits can be purchased at any time. Credit packs are non-refundable once purchased. Unused credits roll over indefinitely while your subscription is active. If your subscription expires, you have a 60-day grace period to reactivate. After 60 days of inactivity, unused credits are forfeited.
• Pricing changes: We reserve the right to change pricing with reasonable advance notice. Price changes will not affect your current billing cycle.
• Taxes: All prices are exclusive of applicable taxes (including GST). Taxes will be added at checkout based on your location.
• Payment processing:All payments are processed by Razorpay. By making a payment, you also agree to Razorpay's terms of service.

By using Modern Leads, you agree to:

• Use the service solely for legitimate B2B sales and marketing purposes.
• Comply with all applicable laws, including anti-spam laws (India's IT Act, CAN-SPAM, GDPR where applicable) when contacting prospects.
• Obtain any necessary legal basis for processing contact data obtained through the platform.

You may not:

• Use the service to send spam, unsolicited bulk messages, or harassing communications.
• Resell, sublicense, or redistribute data obtained through Modern Leads to third parties.
• Use the service to scrape, harvest, or build a competing database or product.
• Attempt to reverse-engineer, decompile, or extract our underlying data sources or algorithms.
• Automate requests in a way that places unreasonable load on our infrastructure.
• Use the service for any illegal, harmful, or fraudulent purpose.
• Share your account credentials with others.

We make reasonable efforts to provide accurate and up-to-date contact information by querying multiple premium data providers. However:

• No accuracy guarantee: We do not guarantee the accuracy, completeness, or currency of any contact data returned by the service. Contact data changes frequently and even verified emails or phone numbers may become outdated.
• Best effort basis: The service operates on a best-effort basis. A failed enrichment (no result found) is not a service failure.
• Verification: Email addresses are verified through our catch-all verification process, but verification is not a guarantee of deliverability in all circumstances.
• Your responsibility: You are responsible for how you use contact data obtained through the platform and for ensuring your outreach complies with applicable laws.

All software, algorithms, designs, and infrastructure underlying Modern Leads are owned by Modern Inbound or its licensors. Nothing in these Terms grants you any rights to our intellectual property beyond the limited license to use the service.

You retain ownership of any data you upload to the platform (such as your prospect lists). By uploading data, you grant us a limited license to process that data for the purpose of providing the enrichment service.

To the maximum extent permitted by applicable law:

• The service is provided “as is” and “as available” without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to lost profits, lost data, or business interruption.
• Our total liability to you for any claims arising from the use of the service shall not exceed the amount you paid us in the 3 months prior to the claim.

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, the above limitations apply to the greatest extent permitted by law.

• Cancellation by you: You may cancel your subscription at any time. Upon cancellation, your access continues until the end of the current billing period. No refund is issued for the remaining period.
• Suspension or termination by us: We reserve the right to suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.
• Effect of termination: Upon termination, your right to access the service ends immediately. We may delete your account data in accordance with our data retention policy.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you by email. Your continued use of Modern Leads after changes take effect constitutes your acceptance of the revised Terms.
